Agency: These booking terms & conditions regulate short term accommodation between The Noosa Collection (TNC) and its guests. The Noosa Collection act as the Agent of the Owner of the Property and accept reservations in that capacity in accordance with these Terms and Conditions. Booking & Payment: In order to secure a reservation a deposit of 50% of the total tariff (including the applicable booking fee) is required. The balance of the tariff must be paid no later than 30 days prior to your arrival date, along with any associated booking/cleaning fees. If you make a booking within 30 days from your specified arrival date, you must pay the full amount at the time of booking. Payment can be made either via direct transfer into the TNC Trust Account or via Credit Card (1.65%) surcharge applies. (Please note that a booking is only guaranteed once a deposit of 50% has been received). General Rules: Before making a booking & paying a deposit, it is your responsibility to have read and understood the Terms and Conditions. We reserve the right to change all or part of these Terms and Conditions at any time and it is your responsibility to keep yourself updated on any changes which will be displayed on our website. Guests and invitees must monitor the observance of these Terms and Conditions at all times. A breach by your invitees/guests will be considered a breach by you. A breach of these Terms and Conditions may result in, but is not limited to, you being evicted from the premises, losing your bond (if applicable) and or a deduction made from your credit card, and a forfeit of all monies paid. If the premises are damaged due to accidental, negligence or wilful act of the guest or the guest’s invitees the premises will be repaired by us at the cost of the guest. Any damage over the amount of $500.00 will result in a report lodged with the Police as malicious damage. We are not required to issue you a tax invoice for any repairs that have been carried out at the premises or for any charges which have been claimed against you. TNC will notify you when the balance of accommodation is due. You authorise TNC to debit the balance of the tariff on the date notified. If payment is not received within 30 days of the booking arrival date, we reserve the right to cancel the booking from that moment onward with no refund provided. At least one form of rental payment must be made via credit card in order to validate your card details prior to your stay. Cancellation: All cancellations must be submitted in writing to The Noosa Collection. If the booking is cancelled 30 days or more prior to the arrival date, a full refund will be issued, less a $120 administration fee, plus any applicable credit card or bank fees. For cancellations made less than 30 days before the arrival date, no refund will be given unless the property is re-let at the same value as the original booking. If the property is successfully re-let, a $120 administration fee, along with any associated credit card or bank fees, will be deducted from the refunded amount, and the remaining balance will be refunded. Refunds will be processed using the same payment method that was originally used for the booking. Note: No refunds will be provided once the guest has checked in or in the event of a no-show. Booking Alteration/Sale of Property: TNC is not responsible for actions beyond their control such as, if the property is sold or withdrawn from holiday letting with TNC for any reason, the property is altered in any way, the property requires immediate urgent repair, or the owner wants the property for their own use or any other reason. If the property becomes unavailable for any reason and the booking is cancelled by the agent, TNC may try to relocate you to an alternative property or provide a refund of any funds already paid. Building/and or Renovation: Our properties are located in suburban locations where building or renovation work may be affected to other properties within the vicinity of the Property. Neither TNC nor the Owner are responsible for any noise from neighbouring properties caused by building or renovation work. No refund or reduction of tariff will be offered for noise from building or renovation work on neighbouring properties. Use of the Property, Parties, Functions & Evictions: The Property is a residential dwelling. The Property is to be used strictly as a residential dwelling for residential purposes by the Guest(s) and the number of occupants nominated at the time of booking. The Property is not to be used for any other purpose or by any greater number of occupants. If any rental is identified as having a party/function (at our sole discretion) we reserve the right to immediately evict all occupants and terminate your booking. Should this happen, all rental monies paid will be forfeited. In addition to this any expense resulting from cleaning, replacement of any furniture/fixture/breakage, including lost keys as well as any repairs will be deducted from the bond or charged to your credit card. TNC and TNC’s contractors reserve the right to immediately evict any guest, visitor, or member of the public for the following (but not limited to) reasons: Intoxication and/or unsavoury/lewd behaviour; Wilful damage to the premises, physical or verbal abuse/assault of our staff, other guests, residents, members of the public on or around the premises, behaviour deemed as a potential safety threat to others, any breach of these Terms and Conditions. Internet Connection: The Property may have a broadband internet connection (wired or wireless). The operation of any internet connection during this reservation is not guaranteed and may be disrupted or not available.Neither the Owner of the Property or TNC is responsible for or liable in respect of the availability or any disruption of any internet connection or its use. Keys/Remotes: Two sets of keys will be provided and must be either left in the property or returned to the office upon departure. Any key(s), remote control or alarm device that is lost or damaged will be replaced or repaired at your cost. This may include the cost of changing locks or having additional keys cut. Animals/Birds: Animals/Birds are only accepted into properties designated by TNC as Pet Friendly and the animal has been approved at time of booking. A fee will be charged to cover the additional cleaning required. Security: All Guests are responsible for keeping the Property secure during their stay and will be responsible for any theft or damage to the Owners or own property due to neglect in this area. It is important to ensure all windows and doors are closed and locked prior to departing the Property. Loss, Damage & Injury: Use of the property, its contents, equipment and facilities are at your own risk. You will be held responsible for any damage, breakages, theft or loss of any property on or in the premises during your stay (including keys). If any property is affected in this manner, you will be responsible for all related costs for the repair or replacement of the affected property. By making your booking and paying a deposit you authorise our Agency to deduct these costs from your bond, monies paid (or owed) by you and or, charge your credit card on file accordingly. No liability is accepted for any injury, debt, damage, loss, delay, expense or inconvenience caused directly or indirectly by events beyond the Agent or Owners control. No responsibility is taken for Guests personal Property left on or near the premises. It is recommended that Guests take out personal Property insurance or adequate travel insurance should any unexpected situations arise before or during your travel period. Maintenance/Breakdown: Air Conditioners, Swimming Pools and electrical appliances are subject to break down and sometimes, delayed repairs. Please report any breakdown as soon as you can. Whilst every effort will be made to repair these items as quickly as possible, no guarantee of their availability or serviceability for the duration of a stay is given. In the event of faults and/or malfunctions of appliances or inclusions, there is no obligation from the owner or agent to compensate or discount. We will accept no responsibility for any inconvenience with machinery breakdown however we will do over very best to repair or replace the item. Body Corporate By Laws: The Guest/s and all other occupants or visitors of the Property will comply with any Body Corporate by-laws and rules applicable to the Property or which regulate the behaviour of occupants of the Property. The Guest(s) and all other occupants and visitors of the Property will not create or permit any noise or other nuisance to occur within or emanate from the Property. Failure to comply with Body Corporate by-laws or rules or the creation or occurrence of noise or other nuisance in or from the Property, may result in the termination of this reservation of the Property and removal of the Guest(s) and other occupants from the Property. Noosa Council STA Laws: A Noosa Shire Council Local Law for Short Term Accommodation requires guests to behave in the following manner. (i) each vehicle used by an occupant of the premises must— (A) be stored in a manner that does not cause a nuisance or inconvenience to adjoining premises; and (B) be parked within the parking facilities at the premises. (ii) each occupant of the premises who enters, uses or occupies the premises, including any outdoor area of the premises, for example, an outdoor entertainment area, deck, balcony, swimming pool or spa, must not— (A) detrimentally affect the residential amenity (including but not limited to noise, overlooking or light spill) enjoyed by residents adjoining, or in the vicinity of, the premises; or (B) cause a nuisance (including a noise nuisance); or (C) display unacceptable behaviour, for example— • loud aggressive behaviour; • yelling, screaming, arguing; • excessively loud cheering, clapping or singing; or (D) create a level of noise which is in excess of the acceptable levels described by Queensland Government legislation for environmental protection (noise); (iii) an occupant of the premises must not sleep or camp on the premises in a tent, caravan, campervan or similar facility; (iv) pets occupying the premises must be managed and not cause a nuisance (including a noise nuisance); (v) each occupant of the premises must store general waste (including the separation of recyclable waste) produced as a result of the ordinary use or occupation of the premises in a waste container; (vi) each occupant of the premises must ensure that the premises, including the grounds of the premises, are kept in a safe and tidy condition. The Guest(s) are responsible for ensuring their behaviour complies with the Code and any anti-social or unacceptable behaviour contrary to the Code may be reported to Council. The Guest(s) indemnify the Owner of the Property and TNC for any finding by Council of a breach of the Local Law and will be liable to reimburse the Owner for any loss resulting from action taken by Council in response to the breach (including, but not limited to, a compliance notice, fine or de-listing of the Property).
