Terms & Conditions

Please read these conditions carefully. The guest by signing the registration form acknowledges and agrees that the following conditions apply and extend to any person (also referred to as “Guest”) occupying or visiting the apartment or complex and/or using the facilities in the complex at the invitation of or with the authority of the Guest. 1. Charges must be paid by cash, bank cheque or credit card before occupancy commences unless special prior arrangements have been made. 2. Occupancy starts and finishes on the dates shown on the receipt. 3. The Guest will be liable for payment of any charges incurred by any Guest together with all replacements and necessary costs for any, damage or loss to the apartment and its contents of the Body Corporate property caused by any guest. 4. The apartment must not be used for any unlawful purpose. 5. Guests must only park in the designated area. 6. Only the number of people shown on the receipt may stay in the apartment overnight. Visitors to leave premises by 10.00pm. 7. No animals or pets are to be brought onto the complex. 8. Neither the Body Corporate, the manager nor the apartment owner is liable for any damage or loss of property which a Guest may sustain while on the complex 9. The by –laws, rules and regulations of the complex and any reasonable direction of the Manager must be complied with. The Apartment must be vacated if after receiving a warning any guest fails to comply. 10. There is no refund for early departure. 11. The Manager may inspect the apartment at any time with reasonable notice and at a time without notice if the Manager is of the opinion that there has been a breach of these conditions. 12. The Manager and the apartment owner are not responsible for any misdescription of the apartment. 13. In the event of the Guest desiring to cancel the booking a refund of the deposit less an administrative fee, will only be made if more than 30 days notice is given in high season or 14 days notice at other times. 14. Guests who reduce length of stay once in house, will not receive a refund on nights booked & paid unless the apartment is rebooked for the same period at the same rate. 15. The Guest authorises the manager to charge any credit card for any loss, damage or monetary contribution for which any Guest is liable under this document or otherwise (including but not limited to breakage, damages or additional cleaning cost). 16. If the occupancy ends or is terminated, the Guest must immediately vacate the apartment. The Manager is authorised to do whatever is required to enforce the eviction of any Guest and removal of Guest’s property 17. Any Guest responsible for a Fire Alarm caused due to negligence will incur a fee/fine from Fire Department – Approx cost $1550. 18. Guest who use the gymnasium facility do so at their own risk. Northwind Mooloolaba accepts no responsibility for any injury. 19. If the guest causes the Manager to wake during the night to attend to a problem created by the guest, then a wake up fee will be charged. BODY CORPORATE BY-LAWS 1. No clothing, bedding or other articles shall be hung on the windows, balconies or on the outside of the building or window thereof. Additionally, no posters, notices signs or advertisements shall be attached to any part of the premises. 2. All rubbish should be disposed of in the appropriate bins. Recyclable rubbish in recycle bins only. No rubbish to be left in stairwells. Tenants and their guests should ensure nothing is thrown from windows or balconies, including paper, cigarette butts or other forms of rubbish. 3. Car spaces shall be kept tidy and free of rubbish. 4. Guests shall not use any chemical, fluid that could increase the risk of fire or explosion in their units. 5. Tenants or their guests should not make or permit any objectionable noises in the building or premises nor interfere or annoy in any way with other residents. All musical instruments or electrical items that emit noise need to be kept to a reasonable level that will not cause annoyance to other occupants. 6. Guests leaving after 10.00pm shall be requested by their host to leave quietly. Quietness also shall be observed when occupants return to the building late at night or early morning hours. 7. In cases of emergency such as fire, guests should exit via the instructions located on the exit door of each unit and follow the instructions of management and staff. 8. No structural alteration should be made to any unit. 9. All pathways and drive ways giving access to the property should not be obstructed. 10. All Apartments and Common Areas are Non-Smoking except the designated smoking area. Party and Noise Policy Northwind Mooloolaba actively enforces a NO Party and Excessive Noise Policy. Parties of any kind, are not tolerated on these premises. Any person(s) found to be creating excessive noise, having a party in their apartment, or exceeding the number of permitted guest’s, will be evicted without refund at the discretion of management. Any subsequent damage will be charged to the guest. Northwind Mooloolaba reserve the right to evict a guest and/or visitors without previous warning. The following is a list of examples (but not limited to) in which management may evict a guest or visitor without warning: 1. Intoxication and un savory behavior 2. Physical or verbal assault towards staff, residents or other guests 3. Willful damage to Northwind Mooloolaba property in either apartment or common area 4. Any incident for which the police and/or security need to be called onto the premises 5. Any behavior posing a threat to others 6. Ignoring advice to reduce excessive noise (i.e. music or other loud noises) 7. Throwing objects from the apartment balconies 8. Smoking in the apartments Release of Liability (as signed by the person, on behalf of each guest, at time of check-in) I on behalf of all guests staying in “Apartment Number” described on Guest Registration form agree to adhere to Northwind Mooloolaba restrictions on Noise and Parties and accept eviction as a result of any breach to the policy as outlined above. The registered guest is personally responsible for the actions of their guests; this includes any person/s known or unknown that they choose to allow into their apartment. I hereby agree to pay for any damage and repair costs(including loss of rental revenue) that may occur as a direct result of my stay in the “Apartment Number” described on the Guest Registration Form. Please note your refusal to agree to these Terms and Conditions, does not exempt you from liability in any shape or form, as described above.
