Terms & Conditions | Emerald Sands Holiday Apartments Welcome to Emerald Sands. All our apartments are individually owned and feature guaranteed ocean views and air-conditioning. Please note that decor, inclusions, and furnishings vary across properties. 1. Guest Age Requirement Minimum Age: Reservations and check-ins will not be accepted if all guests in the party are under 18 years of age. 2. Check-In, Check-Out & Reception Check-In Time: From 2:00 PM. Check-Out Time: By 10:00 AM. Late Check-Outs: Strictly by prior arrangement only. Unauthorised late check-outs will incur a $50.00 fee, deducted directly from your security bond. Mandatory Online Check-In: Three (3) days prior to arrival, you will receive an SMS containing a link to complete your Online Check-In. This process is required for all arrivals. You must provide photo identification, a valid credit card for the security bond, and agree to the house rules. Reception Hours: Monday to Friday: 9:00 AM – 4:30 PM* Saturday: 9:00 AM – 12:00 PM* Sunday: Closed Times may vary without notice. After-Hours Arrivals: If arriving outside reception hours, please notify management in advance to receive key collection and property access procedures via email. 3. Payments & Security Bonds Payment Methods: Outstanding balances must be paid upon check-in via Visa or Mastercard. Cash and American Express (AMEX) are not accepted. Security Bond: A $300.00 pre-authorisation is required at check-in on a valid credit card (must match the credit card used for the deposit). Valid government-issued photo ID (e.g., driver's licence or passport) matching the cardholder's name must be presented. Cash bonds are not accepted. Bond Refunds: Pre-authorisations are released following check-out, subject to the apartment being left in a clean, tidy, and undamaged state. 4. Booking Policies & Cancellations Standard Stays (Excluding Peak Periods) Deposit: A 20% deposit is required at the time of booking. Cancellation: Free cancellation is available up to 7 days prior to arrival. Cancellations made within 7 days of arrival will forfeit the deposit. Rescheduling: Rescheduling a booking within the 7-day cancellation window renders any deposits non-refundable for future cancellations. Peak Period Stays Peak Dates: 11 December 2025 – 26 January 2026 10 April 2026 – 20 April 2026 Deposit: A 50% deposit is required at the time of booking. Final Balance: The remaining balance will be automatically charged to your nominated credit card 30 days prior to arrival. Early Departures Once checked in, early departures for any reason (including government lockdown concerns) will forfeit all remaining funds paid for the stay. 5. Room Types & Capacity Standard 1-Bedroom Apartment: Features a Queen or King bed. Select units include a pull-out sofa or can accommodate a rollaway bed (upon request at booking). Maximum occupancy: 3 guests (including children). 2-Bedroom Apartment: Features a Queen bed in the master room and twin single beds in the second room. Maximum occupancy: 4 guests (including children). Additional Bedding & Linen: Sofa bed linen is available for $35.00 for stays up to 8 days (weekly charges apply thereafter). Additional bedding must be requested at the time of booking. Baby Equipment Hire: For cots and highchairs, please arrange hiring independently through Baby by the Beach Hire at www.babybythebeachhire.com.au by supplying your check-in/out dates and our building address. 6. Resort Amenities & Services Starter Pack: As a self-catering resort, we provide an initial supply of tea, coffee, milk, sugar, dishwashing liquid, laundry powder, toilet paper, and soap upon arrival. Items are not replenished during your stay but can be purchased at reception. Housekeeping: Housekeeping service is provided once a week for bookings of 8 nights or more. Car Parking: Complimentary, secure parking is available (one vehicle per apartment). Internet: Complimentary unlimited Wi-Fi is provided. 7. House Rules & Strict No-Party Policy Quiet Environment: Emerald Sands is a boutique residential property where peace and comfort are prioritized. We strictly enforce a No-Party Policy. Refusal of Entry: Management reserves the right to refuse entry to any group assessed as likely to breach the party policy. Party groups identified upon arrival will be turned away and remain liable for the full cost of the booking. Eviction & Penalties: Hosting a party or disturbing other residents will result in immediate eviction by security personnel without refund. You will forfeit the full balance of your stay and your security bond. 8. Lost & Found Personal items left in apartments or common areas are held for a maximum of 30 days. Returned items require the guest to cover packaging and postage fees. Unclaimed items are disposed of after 30 days. 9. Travel Insurance We strongly recommend purchasing comprehensive Travel Insurance to protect against unforeseen circumstances or travel disruptions. 10. Consumer Guarantees & Limitation of Liability Nothing in these Terms and Conditions excludes, restricts, or modifies any guarantee, right, or remedy implied or imposed by the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010) or any other applicable statutory provision that cannot be lawfully excluded or limited. 11. Force Majeure & Government Directives If your booking cannot proceed due to events beyond the reasonable control of either party—including mandatory government travel restrictions, natural disasters, or emergency public health directives—management reserves the right to issue a credit voucher for the value of payments made (less reasonable unrecoverable administrative expenses) valid for up to 12 months, in lieu of monetary refunds.
